Terms and Conditions for Foodzy.Shop Ecosystem

Welcome to Foodzy.Shop! These Terms and Conditions ("Terms") govern your access to and use of the website, mobile applications—including the Foodzy Customer App, Foodzy Vendor App, and Foodzy Delivery Boy App—and related services (collectively, the "Services") provided by Foodzy.Shop ("we", "us", or "our").

 

By registering, downloading, or using any part of our platform, you agree to be bound by these Terms. If you do not agree, please do not access or use our Services.

 

1. Scope & Multi-App Ecosystem

The Foodzy.Shop platform connects customers, merchant vendors, and delivery partners:

 

  • Foodzy Customer App: Allows users to discover nearby restaurants/stores, place food orders, make payments, and track deliveries.

  • Foodzy Vendor App: Enables restaurant/merchant owners to set up store profiles, list menu items, adjust prices, and manage incoming orders.

  • Foodzy Delivery Boy App: Allows independent delivery partners to accept dispatch requests, navigate delivery routes, and fulfill order deliveries to customers.

2. User Registration & Accounts

  1. Accuracy of Details: All users (Customers, Vendors, and Delivery Partners) must register on the platform by providing accurate, complete, and current information (name, phone number, email address, physical store location, or vehicle/driver credentials).

  2. Verification: Foodzy.Shop reserves the right to verify any information provided, request government identification, or conduct verification checks before approving accounts.

  3. Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

3. Terms for Vendors (Foodzy Vendor App)

  1. Store & Menu Listings: Vendors may list products, menu items, images, and descriptions on the platform. Foodzy.Shop reserves the right to approve, reject, modify, or remove any product listing that violates platform standards or legal regulations.

  2. Pricing Responsibility: Vendors are solely responsible for setting and updating the prices of their products. Foodzy.Shop does not interfere with the pricing decisions of vendors unless an obvious system/display error occurs.

  3. Order Acceptance: Vendors must promptly accept or reject incoming customer orders through the Vendor App and prepare accepted orders within the specified timeframe.

  4. Payments & Commission: Foodzy.Shop collects payments from customers on behalf of vendors. Foodzy.Shop will transfer payouts to the vendor's designated bank account after deducting applicable platform commission fees, taxes, and service charges according to the agreed payment cycle.

4. Terms for Delivery Partners (Foodzy Delivery Boy App)

  1. Delivery Services: Foodzy.Shop operates an integrated delivery network. Independent delivery partners use the Foodzy Delivery Boy App to receive order dispatch requests, pick up prepared orders from vendors, and safely deliver them to customers.

  2. Location Data & Tracking Consent:

     

    • Delivery partners acknowledge and agree that the Foodzy Delivery Boy App accesses and collects precise foreground and background location data (even when the app is running in the background or screen is locked).

    • Background location collection is mandatory to assign nearby delivery orders, calculate route distance, estimate accurate arrival times, track mileage for earnings/payouts, and show live delivery progress to customers and vendors.

  3. Driver Standards & Vehicle Compliance: Delivery partners must maintain valid driving licenses, vehicle registrations, and insurance required by local laws, and adhere to safe road practices during deliveries.

5. Orders, Cancellations & Refunds (Customer Terms)

  1. Placing Orders: Customers can place orders through the Foodzy Customer App or website by selecting items and providing a valid delivery address.

  2. Cancellations:

     

    • By Customer: Customers can cancel an order free of charge only before the vendor accepts the order. Once a vendor accepts and starts preparing the order, the order cannot be canceled, and no refund will be issued.

    • By Vendor/Platform: Foodzy.Shop or the vendor reserves the right to cancel an order due to item unavailability, delivery partner unavailability, or unserviceable address locations.

  3. Refunds:

     

    • Refunds will be processed by Foodzy.Shop in eligible cases of platform-side cancellations, missing items, or wrong order deliveries verified by support.

    • For physical returns or goods disputes, Foodzy.Shop reserves the right to decline refund requests if items are consumed, damaged, or not returned in their original condition.

6. Location & Permissions

By using our applications, you consent to the collection of location data as specified:

 

  • Customers: Location is used while the app is active to surface nearby restaurants and auto-fill delivery addresses.

  • Vendors: Location is used to verify physical store address and set delivery radiuses.

  • Delivery Partners: Location is accessed continuously (including in the background) to manage route navigation, dispatch assignments, and live tracking during active duty.

7. Dispute Resolution & Mediation

In the event of a dispute, quality issue, missing item, or delivery conflict between a customer, vendor, or delivery partner, Foodzy.Shop will act as a neutral mediator and attempt to resolve the matter amicably. However, Foodzy.Shop is not liable for third-party quality, taste, or packaging defaults caused directly by independent vendors.

 

8. Platform Usage & Prohibited Conduct

Users agree not to:

 

  • Use the platform for any illegal, unauthorized, or fraudulent activities.

  • Tamper with software code, reverse-engineer the mobile applications, or introduce malicious code.

  • Create fake user, vendor, or driver accounts to manipulate system promotions, referral rewards, or payouts.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Foodzy.Shop shall not be liable for any indirect, incidental, or consequential damages resulting from app downtime, delivery delays caused by traffic/weather conditions, vendor preparation delays, or unauthorized access to user accounts beyond our reasonable control.

 

10. Updates to These Terms

Foodzy.Shop reserves the right to update or modify these Terms and Conditions at any time. The updated version will be posted on the foodzy.shop website with a revised effective date. Continued use of the platform after changes are posted constitutes acceptance of the modified Terms.
